Your Information. Your Rights. Our Responsibilities
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY. 


Your Rights


When it comes to your health information, you have certain rights, and we will follow any changes mandated by laws or regulations that occur after this writing. These rights include the ability to:
  • Get a copy of your medical record. You may ask to see or obtain an electronic or paper copy of your medical record and other health information about you that we maintain in our designated record set. We will provide a copy or summary of your information, usually within 30 days of your request. A reasonable, cost-based fee may apply.
  • Ask us to correct your medical record. If you believe information we maintain about you is incorrect or incomplete, you may request a correction. In some cases we may deny the request, but if we do we will provide an explanation in writing within 60 days.
  • Request confidential communications. You may ask us to contact you in a specific way, such as calling a particular phone number or sending mail to a different address. We will accommodate all reasonable requests.
  • Ask us to limit certain uses or disclosures. You may request that we limit the health information we use or share for treatment, payment, or health care operations. We are not required to agree to every request and may decline if it could affect your care. If we agree, we may still share information if needed for emergency treatment.
    If you pay for a service or health care item out of pocket in full, you may ask us not to share that information with your health insurer for payment or health care operations. We will agree unless a law requires us to share the information.
  • Receive an accounting of disclosures. You may request a list of certain times we have shared your health information during the six years before your request, including who we shared it with and why. This list will not include disclosures made for treatment, payment, health care operations, or disclosures you asked us to make. One accounting per year is provided at no charge; additional requests within a 12-month period may involve a reasonable fee.
  • Receive a copy of this notice. You may request a paper copy of this notice at any time, even if you previously agreed to receive it electronically.
  • Choose someone to act for you. If you give someone medical power of attorney, or if someone is your legal guardian or personal representative, that person may exercise your rights and make choices about your health information. We will verify that the person has appropriate legal authority before acting.
  • File a complaint if you believe your privacy rights have been violated. You may complain directly to Bloom Mental Health using the contact information at the end of this notice. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by writing to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or by submitting a complaint online at: https://www.hhs.gov/hipaa/filing-a-complaint/index.html. We will not retaliate against you for filing a complaint.

Your Choices About How We Share Information
In some situations, you have choices about how we share your health information.

You may tell us your preferences about whether we share information with family members, close friends, or others involved in your care or payment for your care, or in a disaster relief situation. If you are able to express a preference, we will follow your instructions.

If you are unable to communicate your preference, such as during an emergency, we may share information if we believe it is in your best interest or if necessary to prevent or reduce a serious and imminent threat to health or safety.

Certain uses and disclosures require your written permission. Unless you authorize us in writing, we will not share your information for:
  • Marketing
  • Sale of your information
  • Most sharing of psychotherapy notes

You may revoke your authorization at any time in writing, except where we have already relied on it.
Bloom Mental Health does not currently use patient information for fundraising. If that changes in the future, we may contact you only as permitted by law, and you will always have the right to opt out of fundraising communications.

How We Use and Share Your Health Information
We commonly use or share your health information in the following ways.
  • For treatment: We may use your health information and share it with other health care professionals who are involved in your care. For example, a clinician may consult with another provider regarding your condition, medications, or treatment plan.
  • For health care operations: We may use and share information to operate Bloom Mental Health, improve quality of care, manage services, coordinate treatment, review clinical services, and contact you regarding appointments or care.
  • For payment: We may use and share your information to bill and obtain payment from health plans or other responsible parties. For example, we may send information to your health insurer so it can process payment for services.
  • For public health and safety purposes: We may disclose health information when required or permitted to address important public health matters, such as preventing disease, assisting with product recalls, reporting medication reactions, reporting suspected abuse or neglect when required by law, or preventing a serious threat to someone’s health or safety.
  • For research: We may use or disclose your information for research when permitted by law and subject to applicable privacy protections.
  • To comply with the law: We will share information when required by federal or state law, including with the Department of Health and Human Services if it requests information to verify compliance with federal privacy regulations.
  • For organ and tissue donation: We may share information with organ procurement organizations.
  • To work with medical examiners or funeral directors: When an individual dies, we may share health information with a coroner, medical examiner, or funeral director as necessary for their duties.
  • For certain government and legal purposes: We may disclose information for workers’ compensation claims, to law enforcement officials when permitted or required by law, to health oversight agencies for authorized activities, or for certain government functions such as military or national security activities.
  • For lawsuits and legal proceedings: We may disclose health information in response to a court order, administrative order, or subpoena when permitted or required by law.

In some situations, when information is shared with another organization that is not subject to HIPAA, that organization may be governed by different privacy laws.

Substance Use Disorder Records
To the extent Bloom Mental Health maintains substance use disorder patient records that are subject to 42 CFR Part 2, we will not use or disclose those records in civil, criminal, administrative, or legislative investigations or proceedings against you unless you provide written consent or disclosure is otherwise permitted by law, including pursuant to a court order and subpoena where required. When another applicable law provides greater privacy protection than HIPAA, we will follow the more protective law.

Text Messaging and Mobile Communications

If you provide your mobile phone number and agree to receive text messages from Bloom Mental Health, we may send appointment reminders and other health care service-related messages.

We do not share mobile information with third parties or affiliates for marketing or promotional purposes.
Text messaging opt-in data and consent will not be shared with third parties, except with aggregators and service providers that help deliver messaging services. Information may be shared with service providers only as necessary to support messaging services, appointment scheduling, customer service, and related business operations. These parties are required to maintain the confidentiality and security of your information in accordance with applicable privacy laws.
You may opt out of text messages at any time by replying STOP to a text message or by contacting our office.

Our Responsibilities
Bloom Mental Health is required by law to maintain the privacy and security of your protected health information. We will notify you promptly if a breach occurs that may compromise the privacy or security of your information. We must follow the duties and privacy practices described in this notice and abide by the terms of the notice currently in effect.
We will not use or disclose your information other than as described in this notice unless you authorize us to do so in writing. Other uses and disclosures not described in this notice will be made only with your written authorization.

Changes to This Notice
We may change the terms of this notice, and those changes will apply to all information we maintain about you. Any updated version of this notice will be available upon request, in our office, and on our website.
